Local Sales & Operations Notice
All Believe in Destiny Festival tickets and activity passes are sold and administered locally in Indonesia by PT Happy Days Events Planner Bali, a licensed Indonesian event organiser (EO).
PT Happy Days Events Planner Bali is responsible for all ticketing, payments, event delivery, and insurance coverage under Indonesian law.
BID Entertainment Group Pty Ltd (Australia) does not sell or receive any funds for this Festival and acts solely as the brand owner and international promoter under licence.
Participation in the Festival is governed by Indonesian law, and any claims or disputes must be brought exclusively before the courts of Denpasar, Bali, Indonesia.
1.Introduction 1.1 These terms and conditions (“Terms”) govern the sale and use of tickets (“Tickets”) for the Believe in Destiny Festival (the “Festival”) and related singles events (“Events”). The Festival is organised and operated locally in Indonesia by PT Happy Days Events Planner Bali (the “Festival Operator”) under licence from BID Entertainment Group Pty Ltd (Australia) T/A Believe in Destiny (“BID”). By purchasing a Ticket to the Festival or attending any affiliated Event, you agree to be bound by these Terms. 1.2 These Terms apply to your participation in both the multi-day Believe in Destiny Festival and any affiliated singles events promoted through our website or mobile app. For local singles events operated by independent Destiny Hosts, additional conditions and a different jurisdiction apply (see Section 21).
Glossary
“App” – The official Believe in Destiny mobile application used for event promotion, ticketing, communication, and community engagement.
“Believe in Destiny” / “we” / “us” / “our” – For Festival matters in Indonesia, refers to PT Happy Days Events Planner Bali as the Festival Operator. For Destiny Host licensing and the Believe in Destiny App, refers to BID Entertainment Group Pty Ltd (ABN 94 679 305 182) as licensor/promoter.
“Destiny Host(s)” – Independent third-party facilitators licensed by BID to organise local singles events under the Believe in Destiny banner. Destiny Hosts are not employees or agents of BID or PT Happy Days Events Planner Bali and operate under separate agreements (see Section 21) and are responsible for meeting required standards of safety, conduct, and insurance.
“Event(s)” – Includes the 5-day Believe in Destiny Festival, local singles events, social mixers, workshops, day trips, and potential future travel getaways (e.g. ski trips, boat cruises) hosted or promoted under the Believe in Destiny brand.
“Festival” – The official 5-day Believe in Destiny Festival, currently held in Ubud, Bali, featuring a curated program of wellness activities, workshops, connection-based experiences, and community celebrations. The Festival location is subject to change and will be clearly disclosed prior to each event.
“Festival Operator” – PT Happy Days Events Planner Bali, the licensed Indonesian event organiser responsible for Festival ticketing, payments, delivery, and insurance coverage.
“Participant(s)” / “Attendee(s)” – Individuals who purchase tickets to and/or attend the Festival or any associated Event.
“Ticket(s)” – A digital or physical entry device (e.g., QR/pass) granting the holder the right to attend a specific Believe in Destiny Event or Festival, subject to these Terms and Conditions.
“Third-Party Providers” – External companies or platforms (e.g. payment processors, CRM systems, ticketing platforms like Megatix) used to facilitate aspects of ticketing, registration, communication, or service delivery. These providers operate under their own terms and privacy policies.
2. Ticket Purchase and Entry 2.1 Tickets are personal to the Ticket holder and may not be transferred, resold, or exchanged unless expressly permitted by the Festival Operator. 2.2 Admission to the Festival is limited to individuals aged 18 years and above, unless otherwise specified for specific events or areas within the Festival. 2.3 Festival Tickets are sold locally in Indonesia by PT Happy Days Events Planner Bali and/or approved venue partners. BID does not sell Festival Tickets, collect Festival revenue, or issue Festival receipts. 2.4 By purchasing a ticket, you warrant that you are of sound mind and legal capacity to enter into this agreement.
3. Refunds and Cancellations 3.1 All Ticket sales are final. No refunds will be issued except where required by Indonesian law. 3.2 The Festival Operator reserves the right to cancel, postpone, or relocate the Festival or any part thereof. In such cases, Ticket holders will be notified promptly of any such changes. 3.3 In the event of cancellation of the Festival in its entirety, the Festival Operator will make best efforts to provide alternatives or reschedule the event. 3.4 Some Festival activities may take place at offsite venues. Airfares, transport, accommodation, and other related expenses are not included in the ticket price. The Festival Operator accepts no responsibility for costs incurred should any portion of the event be changed or cancelled.
4. Festival Rules and Regulations 4.1 Ticket holders must comply with all rules, regulations, and conditions of entry established by the Festival Operator and the venue. 4.2 Admission to certain areas or events within the Festival may be subject to additional terms and conditions, age restrictions, or capacity limits. 4.3 Ticket holders must follow all instructions and directives issued by Festival staff, security personnel, and authorised representatives of the Festival Operator.
5. Changes to the Festival 5.1 The Festival Operator reserves the right to make changes to the Festival program, including but not limited to the lineup, schedule, venue, and activities, without prior notice. 5.2 The Festival Operator shall not be liable for any loss or inconvenience caused by changes to the Festival program or cancellation of any part of the Festival due to circumstances beyond its reasonable control.
6. Personal Belongings and Liability 6.1 Ticket holders attend the Festival at their own risk. To the fullest extent permitted by Indonesian law, the Festival Operator accepts no responsibility for any loss, theft, damage, or injury to personal belongings or persons, except where such liability cannot be excluded by law. 6.2 Ticket holders are responsible for the security and safekeeping of their belongings at all times during the Festival.
7. Photography, Recording, and Filming 7.1 Unauthorized commercial photography, video recording, or audio recording at the Festival is strictly prohibited without prior written consent from the Festival Operator. 7.2 By attending the Festival, Ticket holders consent to being photographed, filmed, and recorded by the Festival Operator and/or BID for promotional and marketing purposes. 7.3 All photographs, videos, and recordings made at the Festival by or for the Festival Operator and/or BID are the exclusive property of those entities, which hold full ownership and copyright. 7.4 You further grant the Festival Operator and BID the right to use, reproduce, distribute, and display your image, likeness, and voice in connection with any commercial, promotional, editorial, or marketing materials in any format worldwide, in perpetuity. 7.5 You irrevocably waive any and all moral rights in such materials to the maximum extent permitted by law. 7.6 Media representatives and influencers attending the Festival do so under the condition that they must not misrepresent, defame, or otherwise cause reputational harm to the Festival Operator, BID, or their representatives in public communications. 7.7 The Festival Operator reserves the right to use any media taken at the Festival for promotional purposes, including but not limited to use in social media, advertising, and other digital and print materials.
8. Alcohol and Drug Policy 8.1 The consumption of illegal substances and the possession of unauthorized drugs are strictly prohibited within the Festival grounds. 8.2 Bali has strict laws against the possession and use of illegal drugs, and offenders will be subject to local laws, which may include severe penalties. 8.3 Ticket holders found in possession of illegal substances or engaging in disruptive behaviour due to intoxication may be removed from the Festival grounds without refund.
9. Waiver Notice: Ticket Sales 9.1 By purchasing your Believe in Destiny Festival tickets and presenting your entry device (e.g., digital QR/pass) at Festival check-in, you accept the following Terms, Conditions, and Waivers: the Festival Operator and its representatives, except in cases of wilful misconduct, are not liable for any injury, damage, loss, delay, or irregularity that may occur for any reason during your attendance at Festival venues, including but not limited to death, personal injury, illness, event postponement or cancellation, and loss or damage to personal property.
10. Festival Planning 10.1 The Festival will proceed rain or shine, subject to any necessary changes based on global travel restrictions or other unforeseen circumstances.
11. Entry Device Terms 11.1 Your entry device (digital QR/pass or other identifying device) is required for re-entry to the Festival venue during any single session or day. Damaged or altered entry devices will be considered void and will not be replaced. 11.2 Bring your e-ticket (printed or digital) and photo ID to the Believe in Destiny Festival venue to verify your entry device upon check-in.
12. Ticket Upgrades 12.1 Ticket upgrades to higher-tier categories may be arranged through the Festival Operator’s official channels, subject to availability. 12.2 We encourage purchasing Tickets in advance to avoid disappointment; no Festival Tickets are sold by BID at the venue.
13. Forbidden Activities 13.1 The following items are prohibited within the Festival grounds: • Illegal drugs or substances • Animals (except guide dogs) • Long lens cameras and audio recording equipment • Non-biodegradable rubbish (e.g., plastic bags, hard plastic, metallic wrappers) • Unauthorized distribution of promotional materials or solicitation
14. Force Majeure 14.1 In the event of circumstances beyond normal control, such as war, civil unrest, governmental action, natural disasters, epidemics, or other unforeseen events, the Festival Operator reserves the right to postpone the Festival. In such cases, Ticket holders will be notified of alternative arrangements and rescheduled dates.
15. Ticket Transfer Policy 15.1 Ticket holders may request to transfer their Ticket to another individual. 15.2 Transfer requests must be made at least six weeks prior to the Festival start date through the Festival Operator’s official channels. Transfer requests will be processed within 7 business days. 15.3 All transfers are subject to availability and approval by the Festival Operator.
16. Damaged Entry Devices 16.1 Lost or damaged entry devices will not be replaced, and no refunds will be issued for such cases.
17. Rules & Regulations 17.1 Participants must wear or carry a valid entry device for the duration of the Believe in Destiny Festival. The Festival Operator reserves the right to deny entry to anyone without an authorised entry device. 17.2 The legal drinking age is strictly enforced at the Festival venue. Ticket holders may be asked to present valid identification to purchase alcohol. 17.3 The possession and use of illegal drugs, including substances prohibited by Indonesian law, are strictly prohibited at the Festival. 17.4 Smoking is permitted only in designated areas. 17.5 For details on entry procedures and security screening, refer to Clause 19. 17.6 Unauthorized professional filming equipment, including drones, is prohibited without explicit permission from the Festival Operator. Unauthorized recordings may be confiscated or destroyed. 17.7 Participants are requested to maintain a respectful environment during classes and workshops by refraining from disruptive behaviour, including the use of electronic devices. 17.8 The Festival has a zero-tolerance policy towards abusive or violent behaviour towards staff or attendees. 17.9 By attending the Festival, participants consent to being photographed, filmed, or recorded for promotional purposes by the Festival Operator and/or BID. 17.10 To the fullest extent permitted by law, the Festival Operator and the venue operator are not liable for any loss, theft, or damage to personal belongings during the Festival. 17.11 Public nudity is prohibited at the Festival venue out of respect for local customs and cultural sensitivities. 17.12 Participants are encouraged to use designated bins for waste disposal and minimise plastic use by opting for reusable containers. 17.13 The Festival lineup and schedule are subject to change without prior notice. 17.14 The Festival Operator reserves the right to expel any participant from the Festival grounds at its discretion, without liability, for disruptive behaviour. 17.15 The Festival Operator is not responsible for participants who leave the Festival grounds prematurely or engage in activities outside the Festival venue.
18. Assumption of Emotional Risk 18.1 By attending the Festival or participating in associated activities, including workshops and interpersonal events, you acknowledge that content may be emotionally triggering or evoke unexpected emotional responses. You assume full responsibility for your mental and emotional wellbeing and waive any claim against PT Happy Days Events Planner Bali and BID Entertainment Group Pty Ltd (Australia), their directors or partners, for any emotional distress or psychological injury arising from Festival content, interactions, or experiences.
19. Event Entry and Search Policy 19.1 As a condition of entry, attendees may be subject to security screening, including bag checks and body searches. These measures are in place to protect the safety of all attendees and staff. 19.2 Failure to comply with search procedures or the discovery of prohibited items may result in denial of entry or removal from the Festival grounds without refund. 19.3 The Festival Operator reserves the right to confiscate any items deemed dangerous, illegal, or disruptive.
20. Independent Legal Advice Waiver 20.1 By purchasing a ticket, you acknowledge that you have had the opportunity to seek independent legal advice about these Terms and Conditions, and that your decision to purchase is made freely and voluntarily. You waive any defence related to not having understood or received legal advice prior to agreement.
21. Destiny Host Events Some local singles events listed on our website or app may be organised by independent third-party facilitators known as Destiny Hosts. Destiny Hosts operate as independent contractors, not employees or agents of BID or the Festival Operator, and are licensed by BID to host local events under the Believe in Destiny banner. We do not control the execution of these events and are not liable for any actions, omissions, or outcomes related to Destiny Host activities. By attending such events, you assume full responsibility for your participation and waive any claim against BID or its directors. All Destiny Host activities and licences are governed by Australian law, and any claims or disputes must be brought exclusively before the courts of Brisbane, Queensland, Australia. All Destiny Hosts are contractually required to meet our safety, conduct, and insurance standards.
22. Third-Party Ticketing and CRM Tools
Ticketing and participant information may be processed through third-party platforms, including customer relationship management (CRM) tools and payment vendors, which are subject to change at our discretion.
While we take reasonable steps to ensure these platforms comply with applicable security and privacy standards, we are not responsible for the actions or data practices of these third-party providers.
We may change third-party ticketing, payment, or data management providers at any time without notice. Your continued use of our services or attendance at any Festival or Event implies acceptance of such changes, provided the new providers comply with reasonable data handling and privacy standards.
23. Disclaimer of Warranties and Limitation of Liability The Festival, Destiny Host events, and the Believe in Destiny app are provided “as is,” without warranties of any kind. We disclaim all express and implied warranties, including fitness for a particular purpose. For Festival matters in Indonesia, to the fullest extent permitted by law, the Festival Operator (PT Happy Days Events Planner Bali) and its affiliates will not be liable for any indirect, incidental, special, or consequential damages. For Destiny Host events and the App, to the fullest extent permitted by law, BID Entertainment Group Pty Ltd and its affiliates will not be liable for any indirect, incidental, special, or consequential damages. You agree to indemnify and hold us harmless from any claims related to your conduct, participation, or breach of these terms.
24. Intellectual Property All intellectual property associated with the Festival, app, and singles events—including logos, content, and designs—is owned by or licensed to BID Entertainment Group Pty Ltd and/or the Festival Operator. No rights are granted to attendees or users beyond personal, non-commercial use unless expressly authorised in writing.
25. Related Terms and Policies These Terms should be read in conjunction with: • Our Privacy Policy (available on our website) • The Believe in Destiny App Terms and Conditions (governed by Australian law and Brisbane jurisdiction), which include binding clauses on user conduct, third-party links, content ownership, liability disclaimers, and service limitations • Any additional guidelines or safety terms issued before or during the Festival or affiliated Events. In the event of a conflict, these Terms govern Festival participation in Indonesia; the App Terms govern App use and Destiny Host licensing under Australian law.
Access to App Terms
The Believe in Destiny App Terms and Conditions are hereby incorporated by reference into these Ticketing Terms. These App Terms govern user conduct, third-party integrations, content ownership, and liability disclaimers. They are available exclusively within the official Believe in Destiny mobile application.
In the event of a conflict, these Ticketing Terms shall govern participation in the Festival and Events.
26. Waiver of Class Actions and Jury Trial
To the fullest extent permitted by law, you waive any right to participate in a class action, class arbitration, or other representative proceeding.
You also waive any right to a trial by jury in any legal proceeding related to these Terms, the Festival, or any affiliated events.
27. Severability and Survival
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
Any rights, disclaimers, or indemnities that by their nature should survive termination will remain enforceable after your attendance at the Festival or related events concludes.
28. Director and Entity Protection You agree not to bring any claim, action, or proceeding against the directors, officers, employees, agents, or contractors of PT Happy Days Events Planner Bali or BID Entertainment Group Pty Ltd in any personal capacity. All obligations and liabilities under these Terms are enforceable solely against the corporate entities. To the fullest extent permitted by law, you waive any right to initiate or participate in derivative actions, subpoena directors or officers for personal documents or testimony, or seek discovery from individuals associated with these entities in any dispute relating to the Festival, App, or Events.
30. Jurisdiction 30.1 Festival and on-ground operations (Indonesia): All claims, disputes, or proceedings arising from or relating to the Festival, Festival tickets, Festival venues, safety, or on-ground operations are governed exclusively by the laws of the Republic of Indonesia and must be brought solely before the courts of Denpasar, Bali, Indonesia. 30.2 Destiny Host and App (Australia): All claims, disputes, or proceedings arising from or relating to Destiny Host licensing, Destiny Host events, or the Believe in Destiny App are governed by the laws of Queensland, Australia and must be brought exclusively before the courts of Brisbane, Queensland, Australia. 30.3 Participants waive any objection to venue or jurisdiction on the grounds of forum non conveniens or otherwise, to the extent permitted by law.
31. Governing Law Supremacy In the event of any conflict between the laws of your country of residence and these Terms, the governing law specified in Section 30 applies (Indonesia for Festival; Queensland, Australia for Destiny Host and App) to the fullest extent permitted by law.
32. International Travel Responsibility
Attendees are solely responsible for their own international travel arrangements, including flights, visas, accommodation, and travel insurance. Believe in Destiny shall not be held liable for any travel delays, entry denials, visa issues, or other travel-related disruptions. The purchase of a Festival ticket does not include or guarantee any travel-related support or services.
33. Independent Contractors
Destiny Hosts are independent contractors and not employees, agents, or representatives of BID Entertainment Group Pty Ltd or any related entity. Nothing in these Terms shall be construed to create any partnership, joint venture, employment, or agency relationship between a Destiny Host and Believe in Destiny. Attendees participate in Destiny Host events at their own risk.
34. Limitation of Legal Remedies Your exclusive remedy for any dissatisfaction with the Festival, Events, or App is to cease participation or use. To the maximum extent permitted by applicable law, no refund, replacement, or additional compensation shall be due beyond any remedy expressly required by the applicable governing law in Section 30.
35. Mandatory Travel Insurance All international attendees must obtain comprehensive travel insurance as a condition of participation in the Believe in Destiny Festival or any affiliated travel-based Events. This insurance must cover international medical expenses, trip cancellations or delays, personal liability, and lost or stolen property. By purchasing a ticket, you confirm that you have obtained or will obtain such insurance prior to attending. The Festival Operator, BID, and associated parties accept no liability for any claims, costs, or damages arising from a failure to secure appropriate travel insurance.
36. Force Majeure: Digital Infrastructure The Festival Operator and BID shall not be held liable for any failure or delay in performance arising from outages, downtime, cybersecurity incidents, data loss, or technical failures affecting third-party systems or digital infrastructure (including CRM, ticketing, or app platforms), provided reasonable steps were taken to ensure system integrity.
37. No Reliance
You acknowledge that you have not relied on any representations, warranties, or statements made by Believe in Destiny, its representatives, or affiliates, except those expressly set out in these Terms or required by law. All promotional content, advertisements, or social media materials are for general informational purposes only and do not constitute contractual guarantees.
38. Click-Wrap Confirmation To enhance enforceability, you may be required to confirm acceptance of these Terms—such as by clicking an “I Agree” checkbox—when purchasing Festival tickets or using the Believe in Destiny App. This method of active consent, when presented, shall constitute a binding agreement to these Terms with the Festival Operator (Festival) or BID (App/Destiny Host) as applicable. Where no such step is present, completion of purchase or continued use constitutes acceptance.
39. Optional Dispute Resolution (ADR) Before initiating legal proceedings, the parties agree to attempt to resolve any dispute through informal negotiation. If unresolved, either party may choose to engage in voluntary mediation or arbitration seated in the jurisdiction applicable under Section 30 (Denpasar for Festival matters; Brisbane for Destiny Host/App). This process is non-binding and does not waive the right to pursue formal legal action thereafter.
40. English Language Governs
These Terms are provided in English. If translated for convenience into any other language, the English version shall prevail in the event of any inconsistency or conflict. All disputes, proceedings, and legal interpretations shall be conducted in English.
Governing Law For clarity, Festival matters (tickets, venues, safety, on-ground operations) are governed exclusively by Indonesian law with jurisdiction in Denpasar, Bali. Destiny Host and App matters are governed by the laws of Queensland, Australia with jurisdiction in Brisbane, Queensland, as set out in Section 30.
Privacy Policy By purchasing tickets to the Festival, you agree to our Privacy Policy, which governs how we collect, store, and use personal information. Please refer to the Privacy Policy on the Believe in Destiny website for more details.
